Damien Tansey Solicitors LLP secures ‘Medical Misadventure’ verdict over death of man in his 60s at Galway University Hospital

A verdict of medical misadventure has been returned by Dr. Ciaran McLoughlin, West Galway Coroner, at an Inquest into the death of a 68 year old man at Galway University Hospital (GUH).

Damien Tansey Solicitors LLP acted for the family of Michael Mannion, from Glenamaddy, County Galway, who died on 30th September 2018. Dr. Sine Phelan (Consultant Pathologist) gave the cause of death as Sepsis, Acute Peritonitis and bronchopneumonia, large bowel ischemia with a background of recent aortic graft replacement surgery.

Mr. Mannion, a retired labourer, suffered an abdominal aortic aneurysm. He attended GUH where, in an effort to treat his condition, he underwent a number of procedures including an endovascular repair and a translumbar embolization. Following a repair procedure on 18 th September 2018, Mr. Mannion became progressively unwell. He went on to develop massive pneumoperitoneum due to a perforated colon, from which he never recovered.

During the course of the eight day Coroners’ Inquest, the Clinical Director at GUH expressed serious concerns regarding certain vascular procedures being performed at the hospital.

The Coroner made a recommendation that an Inquiry be held at GUH in order to investigate other previous deaths – for the purpose of preventing similar deaths occurring in the future.

Damien Tansey Solicitors LLP secures €3m interim payment for injuries suffered by 18 month old baby

The High Court has approved an interim payment of €3 million in a settlement for a girl who suffered brain damage after allegedly being discharged from hospital without antibiotics following cranial surgery when she was 18-months-old.

Chloe Flaherty, now 14, is physically disabled and mentally challenged. She was discharged from the Children’s University Hospital (CUH), Temple Street in Dublin in 2009 without antibiotic cover or prescription despite having required antibiotics up to the day of her discharge, it was claimed.

Liability was not admitted by the hospital.

The action was taken through Chloe’s father, Patrick Flaherty, of Radharc Na Farraige, Ballymoneen Road, Knocknacarra, Co Galway.

It was claimed, among other things, that the hospital failed to take measures to ensure she was free from infection prior to discharge, failed to clarify the cause of her persistent high temperatures, and failed to provide sufficient information or advice to the parents about monitoring for further infection.

The claims were denied.

Damien Tansey Solicitors LLP secures Apology from Portiuncula Hospital for failure in care during delivery.

Portiuncula University Hospital in Galway has apologised to the family of a six-year-old boy for the failures in care during his delivery.

Lucas Walker, from Ballinasloe in Galway, suffered a brain injury during his birth in November 2014, the High Court was told.

Damien Tansey SC told the court his mother's labour was mismanaged and the baby’s care was also mismanaged before his transfer to the Coombe Hospital in Dublin.

However, the court heard Lucas had made very good progress despite some developmental difficulties and had a particular aptitude for maths.

He is to receive €450,000 as part of a settlement approved by the court. The vast bulk of that, the court heard, will go towards future care.

An inquest into the death of a 69-year-old woman at the Galway Clinic a year ago following the routine fitting of a pacemaker has returned a verdict of medical misadventure.

Noreen Hanley, a retired nurse from Athenry, went into cardiac arrest after electrodes were erroneously inserted into the wrong place. Dr Gordon Pate has admitted breach of duty and apologised for the failings in her care.

Damien Tansey Solicitors LLP acted for Donegal woman, Della Kerrigan, and were successful in securing a High Court Order, requiring her former friends to repay her almost €300,000 which she had loaned them. The former friends (a Donegal couple) have since declared bankruptcy. John and Jacqueline Keenaghan of Rathmore, Ballyshannon, were made bankrupt by the High Court on 2 March after stating that they could not meet their debts, including the €297,439 they owe to Ms Kerrigan. Aisling Harrison (Senior Associate) of Damien Tansey Solicitors LLP, representing Ms Kerrigan and has accused the Keenaghans of “exhausting all avenues in a bid to tactically delay and frustrate matters” for her client.
